Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of Fly Edge Creators (“the Platform,” “we,” “our,” or “us”), a creator automation SaaS platform operated by FlyEdge Systems. By accessing or using the Platform, including our website, AI-powered tools, and Instagram integration features, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, or using Fly Edge Creators, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any applicable Meta Platform Policies. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization.

2. Account Registration & Security

• You must provide accurate, current, and complete information during registration and keep it updated.
• You are solely responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account at support@flyedgesystems.com.
• You may not create accounts through automated means or use another user’s account without permission.
• You must be at least 13 years of age (or 16 in the European Economic Area) to use the Platform.
• Each user may maintain only one account unless otherwise authorized in writing.

3. Acceptable Use

You agree to use Fly Edge Creators only for lawful purposes and in accordance with these Terms. You may use the Platform to:

• Create and manage your public link-in-bio profile.
• Analyze scripts and content using our AI tools.
• Connect your Instagram account to view analytics and insights (where authorized).
• Generate content ideas and drafts for your own use.

4. Prohibited Conduct

The following activities are strictly prohibited on Fly Edge Creators. Violation may result in immediate account suspension or termination without notice:

Spam & Automation Violations

• Using the Platform to send spam, unsolicited messages, or bulk communications.
• Automating interactions on Instagram or any third-party platform through our services, including automated likes, comments, follows, unfollows, direct messages, or post scheduling.
• Using bots, scrapers, scripts, or other automated methods to access, collect, or extract data from the Platform or any connected third-party service.
• Engaging in or encouraging any activity that violates Meta’s Community Guidelines, Platform Terms, or Instagram’s Terms of Use.

General Prohibitions

• Uploading or transmitting viruses, malware, or any malicious code.
• Attempting to bypass, disable, or interfere with security features, rate limits, or access controls.
• Reverse engineering, decompiling, or disassembling the Platform or its components.
• Using the Platform to distribute hate speech, harassment, defamatory content, or illegal material.
• Impersonating another person or entity, or misrepresenting your affiliation with us.
• Using the Platform in any way that could harm minors or exploit their data.
• Interfering with or disrupting the integrity or performance of the Platform or its infrastructure.
• Accessing or attempting to access data that does not belong to you.
• Violating any applicable local, state, national, or international law.

5. Instagram API & Meta Platform Compliance

Fly Edge Creators integrates with Instagram through Meta’s APIs. By connecting your Instagram account, you agree to comply with:

• Meta Platform Policy
• Meta Terms of Service
• Instagram Terms of Use
• Meta Data Policy

You represent and warrant that:

• You own or have the necessary rights to any Instagram account you connect to the Platform.
• You will not use data obtained via Instagram APIs for any purpose prohibited by Meta’s Platform Policies, including but not limited to advertising targeting, eligibility determinations, or unauthorized data sharing.
• You will not use Instagram data obtained through our Platform outside of the Fly Edge Creators interface without explicit written permission.
• You understand that Instagram data accessed through our Platform must be deleted or disconnected upon your request or when you close your account.
• You will not use the Platform to automate any restricted Instagram actions (likes, comments, follows, unfollows, DMs, or posting) as prohibited by Meta’s Platform Policies.

We reserve the right to disable Instagram integration for any account that violates Meta’s policies or these Terms.

6. AI-Generated Content Disclaimer

Fly Edge Creators provides AI-powered tools for script analysis, content suggestions, and creative assistance. You acknowledge and agree that:

• AI-generated outputs are suggestions only and may contain errors, inaccuracies, or biases. You are solely responsible for reviewing, editing, and verifying any content before publishing or using it.
• AI-generated content does not constitute professional, legal, or financial advice.
• We do not claim ownership of AI-generated outputs. Ownership of the content you create using our tools belongs to you, subject to the rights of any third parties whose intellectual property may be incorporated.
• You are responsible for ensuring that AI-generated content does not infringe on the intellectual property rights, privacy rights, or other legal rights of any third party.
• You must comply with applicable disclosure requirements. Depending on your jurisdiction, content generated or substantially modified by AI may need to be labeled as AI-generated. We recommend reviewing applicable laws and platform policies (e.g., Instagram’s AI content labeling policies).
• We make no guarantees regarding the accuracy, completeness, or usefulness of AI-generated outputs. The AI features are provided on an “as-is” basis.
• You may not use AI features to generate content that violates these Terms, including hate speech, harassment, illegal material, or misleading information.

7. Subscriptions & Payments

Certain features of Fly Edge Creators may require a paid subscription. The following terms apply to all subscriptions:

• Fees: Subscription fees are as displayed on our pricing page and are subject to change with 30 days' notice.
• Billing: Fees are billed in advance on a monthly or annual basis, depending on your selected plan. Payments are non-refundable except as explicitly stated in these Terms or as required by law.
• Free Tier: We may offer a free tier with limited credits that reset daily. Credits do not roll over and have no monetary value.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
• Payment Processing: Payments are processed by our third-party payment processors. We do not store full payment card details on our servers.
• Taxes: You are responsible for all applicable taxes, and we may charge taxes as required by law.
• Price Changes: If we increase subscription fees, we will notify you at least 30 days in advance. Continued use after the price change constitutes acceptance of the new fees.

8. Account Suspension & Termination

We reserve the right to suspend or terminate your access to Fly Edge Creators under the following circumstances:

Termination by You

• You may delete your account at any time through your Dashboard settings or by contacting support@flyedgesystems.com.
• Upon account deletion, your data will be deleted or anonymized within 30 days, except where retention is required by law.
• Subscription fees already paid are non-refundable upon voluntary account deletion.

Suspension or Termination by Us

• Violation of these Terms, including prohibited conduct listed in Section 4.
• Violation of Meta Platform Policies or Instagram Terms of Use.
• Non-payment of subscription fees after a grace period.
• Creating a risk of legal liability or harm to the Platform, its users, or third parties.
• Extended period of inactivity (over 12 consecutive months).
• If required by applicable law or a valid legal request.

We will make reasonable efforts to notify you before suspension or termination. However, we may suspend access immediately if we reasonably believe that continued access poses a security risk or violates applicable law. You may appeal a suspension by contacting appeals@flyedgesystems.com.

9. Intellectual Property

The Fly Edge Creators Platform, including its code, design, logos, trademarks, and proprietary features, is owned by FlyEdge Systems and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform in accordance with these Terms.

You retain ownership of any content you create or upload using Fly Edge Creators. By submitting content to the Platform, you grant us a limited license to store, process, and display that content solely for the purpose of providing our services to you. We do not claim ownership of your content.

10. Platform Limitations & Disclaimers

Fly Edge Creators is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• That the Platform will be uninterrupted, error-free, secure, or free of viruses.
• That AI-generated outputs will be accurate, reliable, or suitable for your purposes.
• That Instagram API access will remain available or uninterrupted. Instagram API availability depends on Meta and is outside our control.
• That the Platform will meet your specific requirements or expectations.
• That any defects or errors will be corrected in a timely manner.

Service Interruptions: We strive for high availability but do not guarantee uptime. We are not liable for interruptions caused by:

• Maintenance, upgrades, or feature deployments (we will provide reasonable notice when possible).
• Third-party service outages (including Meta/Instagram APIs, cloud infrastructure, or AI providers).
• Factors outside our reasonable control, including acts of God, natural disasters, war, strikes, or government actions.
• Your own internet connection, hardware, or software.

No Guarantee of Specific Results: Fly Edge Creators provides tools and insights to assist creators. We do not guarantee any specific outcomes, including follower growth, engagement rates, revenue, or content performance.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FlyEdge Systems and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the greater of $100 USD or the amount you have paid us in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless FlyEdge Systems and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Platform in violation of these Terms.
• Your violation of any third-party rights, including Meta’s Platform Policies or Instagram’s Terms of Use.
• Your content or AI-generated outputs that infringe on any intellectual property or other rights.
• Any dispute between you and another user of the Platform.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting support@flyedgesystems.com. We will respond within 30 days and work in good faith to resolve the issue.

Arbitration: If the dispute cannot be resolved informally, it shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Wilmington, Delaware. Each party shall bear its own costs and fees.

Class Action Waiver: All disputes shall be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or through an in-app notice at least 30 days before taking effect. Your continued use of Fly Edge Creators after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and delete your account before the new Terms take effect.
